Legal Aspect of Surrogacy in India

Surrogacy has been legal in India since 2002. More and more Intended Parents from around the world are choosing India as their surrogacy destination as laws in India are simpler and surrogacy is cost effective than anywhere else in the world. The surrogacy laws in India are based on the guidelines provided by Indian Council of Medical Research and can be accessed here (ICMR guidelines for surrogacy).

Surrogacy Agreement: The surrogate mother and the intending parents enter into a legally binding contract called the Surrogacy Agreement. The legal team at JFMCH, comprising of eminent lawyers and experts, prepare this agreement. This agreement spells out the responsibilities of both the Intending Parents and the potential surrogate mother under the Indian Contract Law. By signing this Surrogacy Agreement, the potential surrogate mother signs away the parental rights on the baby she carries.
